Student loan payments missed after the on-ramp ended no longer stay off your credit report. A late payment can now sit in your file like a missed card bill, and millions of borrowers are already behind.

Some borrowers saw it as a life sentence. Others hope the right letter will erase it. A late mark is accurate history until it ages off, and the damage that moves fast starts when the loan slides into default.

Student Loan Late Marks Now Count Like Any Other Late Payment

A late federal student loan payment is now ordinary credit history, and payment history carries 35% of a FICO Score (myFICO). That is the biggest single slice of the score, which is why one late mark can hurt so much.

FICO lists the late categories creditors report as 30 days, 60, 90, 120 and 150 days late, then charge off. It says a 90-day late is worse than a 30-day late and a recent late payment weighs more than an older one. The date a late payment first reaches your file is on your report, so pull all three, find the loan, and read its payment history.

Under Section 605 of the FCRA, a late payment is an adverse item that can be reported for seven years. The clock runs on the mark itself.

How Many Student Loan Borrowers Are Already Behind?

On April 21, 2025, the Department of Education said more than 5 million federal student loan borrowers had gone over 360 days without a monthly payment and sat in default. Another 4 million were 91 to 180 days past due. The Department projected nearly 10 million borrowers, almost 25% of the federal portfolio, could be in default within months.

The New York Fed found the trend continuing. About 1.0 million federal student loan defaults were reported to the credit bureaus in the fourth quarter of 2025, and another 2.6 million in the first quarter of 2026 (Liberty Street Economics, 2026). Those counts cover the deep end, default, where the largest score damage sits.

A Late Mark Becomes a Default at 270 Days Past Due

For a federal Direct Loan, default means the missed payment persists for 270 days (34 CFR 685.102(b)). Until then you are late or delinquent. After that the loan is in default, and the rules for collecting it change.

The damage is steep. Borrowers who newly defaulted saw their credit scores fall an average of 91 points, from 567 to 476, between the third quarter of 2024 and the fourth quarter of 2025 (Liberty Street Economics, 2026). That is the average for newly defaulted borrowers, so it describes default and says nothing about a single late mark.

Default also spreads through a household. Among borrowers who newly defaulted as of the first quarter of 2026 and held a credit card, 56% were past due on the card (Liberty Street Economics, 2026). A student loan problem becomes a card problem fast.

Default Lets the Government Collect Without Suing You

On a defaulted federal student loan, the Department of Education or a guaranty agency can garnish up to 15% of your disposable pay with no lawsuit and no court judgment (20 U.S.C. 1095a). You get at least 30 days’ written notice first. If you ask for a hearing within 15 days of that notice, the hearing comes before any garnishment order issues.

After day 15 you still get a hearing, but the order can go out first. Missing that 15-day window costs you the stay, so the notice letter is not one to leave in a drawer.

The same default can also take your tax refund. Under 31 U.S.C. 3720A and 26 U.S.C. 6402(d), Treasury reduces the refund and pays it to the agency owed. The Department announced it was resuming collections on defaulted loans on April 21, 2025.

Rehabilitation Clears the Default Mark but Not Earlier Late Marks

If a loan has already defaulted, rehabilitation is the exit that deals with the credit report. Under 34 CFR 685.211(f), you make nine voluntary, reasonable and affordable monthly payments, each within 20 days of its due date, across 10 consecutive months. The rule then directs the Department to instruct the bureaus to remove the default from your credit history.

The late payments from before the default are outside that instruction. They stay as the history they are and age off on their own seven-year clock.

The payment amount follows an income-driven formula, with a floor of $5 before July 1, 2027. It is not a fixed $50 minimum. A loan on which a judgment has been obtained cannot be rehabilitated, and a loan rehabilitated before July 1, 2027 cannot be rehabilitated again if it returns to default.

Consolidation looks faster, but a judgment or an active wage garnishment order closes that door as well (34 CFR 685.220(d)(1)(i)).

Get Current or Change Plans Before the Count Reaches 270

FICO says a consumer can recover from a late payment before charge off by getting and staying current. For federal student loans, the cheapest time to change course is before the count climbs, because a payment you can afford beats a missed one at any size.

The Repayment Assistance Plan became available July 1, 2026. It sets your payment between 1% and 10% of income, with a $10 minimum and $50 off per dependent, and forgives any remaining balance after 360 qualifying payments (U.S. Department of Education). It is the only income-driven plan open to a borrower whose loans were all first disbursed on or after July 1, 2026.

Borrowers with earlier loans keep income-based repayment, which allows a $0 scheduled payment at low incomes. Call your servicer before the next due date and ask which plan fits your income.

Check Every Late Mark Against Your Own Records

The FTC’s national accuracy study found one in five consumers had an error on at least one of their three credit reports (FTC, 2013). Pull your reports free at AnnualCreditReport.com and compare each late mark with your servicer’s payment history. A payment you made on time, a loan that is not yours, or a wrong delinquency date are all worth disputing.

An accurate late mark does not come off because a letter asks. A furnisher may not report information it knows or has reasonable cause to believe is inaccurate (FCRA Section 623(a)(1)(A)). If a bureau’s reinvestigation finds an item inaccurate, incomplete or unverifiable, it must delete or modify it (Section 611(a)(5)(A)). That is the line between a dispute and a promise.

Firms have sold the promise anyway. On September 30, 2024, the CFPB took action against Commonwealth Equity Group, doing business as Key Credit Repair, for charging advance fees before achieving durable results and misrepresenting its ability to remove negative credit items. The order was for $41.3 million.

Time does the work no service can speed up. Manuel Gomez, a 2-star Trustpilot review of Lexington Law, September 9, 2026: “They had me on premium service when I never agree to that service I don’t even know how I got premium it was almost 200 dollars a month , on top of that on six months they only clean one collection out of 10 ,the other collections started falling off by themselves because the 7 mark period , not because they were cleaning them , and yeah still charging me for not doing anything”. Among Lexington Law’s latest 200 Trustpilot reviews, 79 of its 134 one- and two-star reviews said they paid for months and nothing changed.
