Being sued over a credit card is frightening, and the worst move is the quiet one: letting the papers sit. If nobody answers, the court rules for the creditor. That ruling is a default judgment, and it can reach your paycheck and your bank account.
You can avoid one by answering the lawsuit, and you can still act on one if you move fast. The part people leave alone is the credit report, where wrong or unverifiable entries can be disputed with CreditRefresh, which drafts the letter and leaves the review and signature to you.
What is a default judgment on credit card debt?
A default judgment is a court ruling for the creditor or debt collector because you did not answer their lawsuit in time. The court takes the creditor’s claim at face value, which is why a late or missing response costs people the chance to dispute anything.
Over the decade to 2020, Pew Charitable Trusts found, courts resolved more than 70% of debt collection lawsuits with default judgments for the plaintiff in the places with court data. The ruling does not say the debt was right. It says nobody showed up to question it.
How does a credit card company get a default judgment against you?
It starts when an account falls far behind and the creditor or a collector sues and serves a summons and complaint. If no written response is filed before the deadline, the plaintiff asks the judge for a default judgment. The steps run in a fixed order, so the date you were served sets your deadline.
That deadline belongs to the court. Rule 502.5(d) of the Texas Rules of Civil Procedure sets 14 days in justice court (rule text read September 17, 2026). California Code of Civil Procedure section 412.20(a)(3) tells a defendant to respond within 30 days after service (statute text read September 17, 2026). Your summons prints your number.
Never set court papers aside, even if you think the debt is too old. An old debt is a point to take to a lawyer, not a reason to skip the paperwork.
What can a creditor do after a default judgment?
With a judgment, a creditor can ask the court for wage garnishment, a bank account levy or a lien on property, tools that phone calls and letters never reach. Interest can keep running on the judgment, and some states allow it to be renewed for years.
Federal law sets a ceiling on paycheck garnishment for ordinary debt. Under 15 U.S.C. 1673(a), the most that can be taken in a week is the lesser of 25% of disposable earnings or the amount those earnings exceed thirty times the federal minimum hourly wage (statute text read September 16, 2026). A state may set the limit lower. Social Security benefits carry their own federal protection, so raise that with a lawyer if benefits are your income.
Does a default judgment show up on your credit report?
A judgment can still turn up in public records and background checks even where the credit bureaus no longer list it, and the credit card account behind it stays on your reports. Those account entries are the part to check for mistakes, and that is where reading all three bureau reports pays off.
The CFPB reported in February 2018 that 6% of consumers had a civil judgment or tax lien on their credit record in June 2017. After the bureaus applied new public-record standards on July 1, 2017, none had a civil judgment.
We read your reports, find items that look inaccurate, incomplete, unverifiable or too old to be reported, and draft a letter for each. If you owe a balance and the creditor reports it accurately, we won’t generate a dispute letter for it.
How do you respond to a credit card lawsuit before a default judgment?
File a written response with the court within your state’s deadline, because answering is what keeps the case from ending in default. Responding lets you ask the creditor to prove the debt, check who owns it and whether the amounts are right, or talk settlement. Get legal help if you can.
Pew Charitable Trusts reported in July 2026 that fewer than 4% of people sued over a debt have legal representation. Even one consultation with an attorney on your papers is worth seeking.
Work in order. First, write down the date you were served and the deadline on the summons. Then file your answer and keep copies of everything. If a collector contacts you, a written dispute within the validation period generally means it must stop collecting that debt until it sends verification. A request after that period does not automatically pause collection.
Paying a debt that is invalid or can’t be verified can waste money and won’t necessarily help your credit. And owing a debt is not a crime and cannot lead to jail. A warrant can follow only from ignoring a court order.
Can you get a default judgment vacated or settled?
A motion to vacate or set aside asks the court to reopen the case, usually on proof of improper service or a good reason you missed the deadline. Creditors will sometimes settle even after judgment, because collecting costs them time and money. Act fast: delay narrows both routes.
The time limit for a motion depends on the court, so a lawyer should read your papers before you count days yourself. As for settling, the FTC’s 2013 study of debt buying found that buyers paid an average of about 4 cents per dollar of face value. A buyer that paid so little may weigh a smaller payment against the cost of collecting. No creditor has to agree, and a lawyer can tell you what to ask for.
How do you dispute wrong credit card debt on your credit report?
Pull all three reports, find the specific entry that is wrong, and dispute it in writing with each bureau that shows it. Under Section 611 of the FCRA, a bureau generally has 30 days to investigate, forward your evidence to the lender or collector, and delete or correct anything it can’t verify. The bureaus decide the outcome.
You can also write to the lender or collector yourself. Under FCRA Section 623(a)(8), a consumer may dispute accuracy directly with the furnisher, which must investigate and report the results (statute text read September 16, 2026). That route runs alongside a bureau dispute and does not replace it.
The right is free. The work is reading three reports, drafting a letter per item, mailing and tracking 30 days. We pull reports from all three bureaus, scan for errors and FCRA violations, and draft letters that cite the specific issue and its statutory basis. Dispute only what is actually wrong. Accurate, current, verifiable information stays on the report, and no one can lawfully change that.
Which tools help fix credit report errors after a judgment?
Credit-repair firms, passive monitoring apps and dispute software each handle the credit-report side differently, and a tool that reaches one bureau leaves two reports untouched. Price and reach are the first things to weigh before you pay anyone.

Every price is that company’s own published rate, read off that company’s own site on September 15, 2026. Trustpilot scores and review counts as published on October 5, 2026.
If you paid for one of these and got nothing, the reviews say you are not alone. Of 126 one- and two-star Trustpilot reviews of rival tools, 22 say nobody answers. Peter, a DisputeBee reviewer, 1-star Trustpilot review, April 14, 2026, wrote: “Customer service is non existent. Literally there isn’t a human to respond to you.. I’ve left 10 voice messages, 15 emails and 15 chat attempts. Not one response in three weeks.” Before you pay, ask how you reach a person.
Another 20 of the 126 say they paid for months and nothing changed. Kay, a The Credit People reviewer, 1-star Trustpilot review, July 9, 2021, wrote: “it’s been 6 months of giving the credit people my money monthly at $79 a month to raise my credit score , instead of my credit getting better over the months it got worse like terrible” Ask what each letter says and whether you see it before it goes. Smaller groups name report data that does not match (8), credit pulls or offers they did not ask for (6), no idea what was done (5) and fees they did not expect (4).
The court case needs a lawyer or a timely answer. The credit report needs a letter that names the specific error.

Frequently Asked Questions
How long do you have to respond to a credit card lawsuit?
It depends on the court, and your summons prints the deadline. California’s code points to 30 days after service, and Texas justice court sets 14. Count from the day you were served and file before it passes.
Can a default judgment be removed from your credit report?
The CFPB found in 2018 that none of the consumers it studied had a civil judgment on their credit record after July 2017. The credit card account behind the judgment can still appear, and negative accounts can be reported for seven years under the FCRA. Wrong or unverifiable entries can be disputed, and accurate ones stay.
How long does a default judgment last?
State law sets how long a judgment can be enforced and whether it can be renewed, so ask an attorney in your state. That clock is separate from the seven-year reporting limit on the account.
Can they garnish your wages for a credit card debt judgment?
With a judgment, yes in most places. Federal law caps ordinary-debt garnishment at 25% of disposable earnings or the amount over thirty times the federal minimum hourly wage, whichever is less. Texas and Pennsylvania are among the states that bar it for ordinary consumer debt, according to each state’s own constitution or statute (Texas Constitution article XVI, section 28; 42 Pa.C.S. 8127).
Should you ask a collector to verify a debt before it sues?
If a collector contacts you, ask in writing within 30 days of its validation notice. The collector generally must stop collecting that debt until it sends verification. The Fair Debt Collection Practices Act’s validation rules, as set out in 15 U.S.C. 1692g, govern debt collectors, and whether a debt buyer counts as one can depend on its principal purpose, so ask an attorney about your collector.
Does CreditRefresh send my dispute letters for me?
We draft the letters and you review and sign each one. You can print and mail them yourself, or have RushMail, our mailing partner, send them for a small per-letter fee. Downloading letters adds no mailing fee from us, though you pay printing and postage.
CreditRefresh reads all three of your credit reports after a judgment, flags entries that look inaccurate, incomplete or unverifiable, and drafts a letter for each that you review and sign.
