Hire an FCRA attorney when a credit bureau or lender keeps verifying an error after you have disputed it in writing with proof, when an old or wrong item keeps coming back, or when the error has already cost you a loan, a job or money. Only a lawyer can sue under the FCRA and recover damages, and a credit repair company can’t.

Until that point, a dispute letter you review, sign and send yourself is the lower-cost first step. If you already paid a monthly service and the same wrong item is still on your report, the line between those two steps is what you need to find.

Hire an FCRA attorney when a bureau keeps verifying an error you disputed

Hire an FCRA attorney when a credit bureau or lender keeps saying an item is “verified” after you sent written proof that it is wrong, when the error keeps coming back, or when it has cost you a loan, a job or money. A lawyer can bring a federal case under the FCRA and a credit repair company cannot.

The CFPB confirms that you may sue credit reporting companies that break the law for damages and attorney fees (Consumer Financial Protection Bureau, 2024). Three situations can support that kind of lawsuit: a bureau reinserts a deleted item without the required certification and notice, a bureau fails to investigate or blows the 30-day deadline and keeps reporting the item, or a furnisher keeps reporting information it knows is inaccurate after a dispute. Private-action situations like these need an attorney.

A “verified” reply means the bureau reported the information as verified. By itself it does not settle whether the error is still there, which is why the proof in your letter matters.

What can an FCRA attorney do that a credit repair company can’t?

A credit repair company is a business that audits your reports and sends dispute letters. It cannot sue, appear in court for you or give legal advice, and an FCRA attorney can do all three.

The statute puts real money behind that difference. A person who willfully breaks the FCRA owes the consumer actual damages or $100 to $1,000, any punitive damages the court allows, and costs plus reasonable attorney’s fees. A person who is negligent owes actual damages plus costs and fees (Fair Credit Reporting Act, 1970). A letter-mailing service cannot reach any of those remedies, because they are decided in a courtroom.

How do FCRA attorneys get paid compared with credit repair firms?

The FCRA lets a court order a violator to pay your costs and reasonable attorney’s fees after a successful case, so a lawyer’s bill can land on the party that broke the law. A credit repair firm’s bill lands on you every month: traditional firms charge $79 to $139 a month plus a setup fee.

Lexington Law publishes a monthly rate of $139.95, invoiced at the end of each service period, the highest monthly price in our comparison table. The Credit People lists $99 a month for Standard and $119 for Premium. On Trustpilot, Jennifer C. gave one star to a review of Lexington Law on March 20, 2024: “Their policy read they would initially charge $14.95 but $99 was withdrawn from my account.” Before you sign with any lawyer, ask how fees will be handled.

What can a credit repair company actually do for your credit report?

It can audit your reports and send dispute letters. It cannot take accurate, current negative information off your report, because no one can legally do that, and it is illegal for these companies to charge before they perform services (Federal Trade Commission, 2026).

Reviewers of firms that charge by the month describe this problem in their own words. Among the 134 one- and two-star reviews in Lexington Law’s latest 200 on Trustpilot, 79 describe paying for months with nothing changed. The Credit People holds a 1.7 Trustpilot score across 18 reviews, all one star, and 12 of those 18 raise the same complaint. A one-star Trustpilot review of The Credit People from Brenda, May 3, 2023, reads: “Slow service no communication”. Paying for months with nothing changed is the top complaint in both firms’ recent low-star Trustpilot reviews.

What signs mean your dispute has failed and it is time for a lawyer?

Any one of these, backed by your dispute letters and the bureau’s replies, is the point to talk to an FCRA attorney. Each matches a rule the FCRA sets for the bureau or the lender, and that rule is what a lawyer enforces.

  • A bureau keeps verifying it after written proof. You sent documents, and the answer was still “verified.”
  • A deleted item comes back. A bureau may not reinsert deleted information unless the furnisher certifies it is complete and accurate, and it must notify you in writing within 5 business days.
  • The bureau misses its deadline. It generally has 30 days to investigate and 5 business days after that to notify you, or up to 45 days if you add relevant information mid-investigation (Consumer Financial Protection Bureau, 2025). A missed deadline is not always followed by automatic deletion.
  • An item is past its reporting window. Collections and charge-offs may be reported for seven years, counted from 180 days after the delinquency that led to them, and bankruptcies for ten (Fair Credit Reporting Act, 1970). Confirm the item type and its dates before you assert the window has run.
  • The error cost you. A loan denial, a lost job or money you paid is the harm damages are measured by.

Should you dispute a credit report error yourself before hiring anyone?

Yes. Your right to dispute errors with the bureaus and the furnishers is free, and the CFPB says they must investigate and fix mistakes as needed, usually within 30 days, at no cost to you (Consumer Financial Protection Bureau, 2026). A letter you review, sign and send yourself starts the clock and builds the file a lawyer will ask for.

The cost of doing it yourself is work: reading three reports, drafting a letter per item, mailing and tracking 30 days. A dispute that follows the CFPB’s published steps becomes a record rather than a simple request.

  1. Put your full name, address and phone number in the letter, with your report confirmation number if you have one.
  2. List each error and the account number of any account you dispute.
  3. Explain why each item is wrong and ask that it be removed or corrected.
  4. Attach the part of your report with the disputed items circled or highlighted.
  5. Attach copies, not originals, of documents that support you.
  6. Send it to Equifax, Experian or TransUnion online, by mail or by phone. Certified mail with a return receipt gives you proof it arrived.
  7. Keep copies of the letter and everything you sent with it.
  8. The bureau must investigate, forward your dispute and proof to the furnisher, and report back. It generally has 30 days, then 5 business days to notify you.
  9. To dispute with the furnisher too, send it in writing by certified mail. Furnishers generally must respond within 30 days.
  10. If the furnisher gave wrong information or cannot verify it, it must update or remove it and notify all the credit reporting companies.

We built CreditRefresh for that work. It reads your reports, flags items that look inaccurate, incomplete, unverifiable or too old to be reported, and drafts a letter for each one. If you face a lawsuit, garnishment or active identity theft, an attorney is a better fit, and support@creditrefresh.ai can help you find the right next step.

What paper trail should you bring to an FCRA attorney?

Bring your letters, your mailing receipts, the date each bureau received them and every reply. A claim is built on what you disputed, when, and what came back, and verbal or vague disputes are hard to build on. Add your report from before and after, and any notice that a deleted item returned.

If a bureau says “verified,” keep the response and write down what is still wrong and the proof for it. You may also request a description of the procedure it used, and the bureau has 15 days to respond. That is not a right to every underlying record. When a dispute, a verification and a request for that description have all come back unhelpful and the item is still clearly wrong, the next step is usually a CFPB complaint or an attorney, not another letter. If you think the FCRA was violated, talk to a consumer attorney well before the two-year mark.

A lawyer takes over where your own letters stop working

The monthly service was never the tool that could enforce the law. A documented dispute you sent yourself gets you to the starting line, and a lawyer is who you call when the bureau or lender still will not follow the rules, or the error has already cost you. What separates the ways of getting that first dispute out is price and who holds the pen.

What each way of fixing a credit report costs and who sends the letters

At $49.99 a month we cost less than The Credit People’s $99 and Lexington Law’s $139.95, and you review and sign every letter. Each monthly fee buys a different step, so you can see which one you are paying for before a lawyer is the right call.

Skip the paperwork. Start your dispute.

CreditRefresh drafts your FCRA dispute letter and tracks the 30-day investigation window. You review, approve, and send. You stay in control.

How CreditRefresh drafts a letter for each flagged item at $49.99 a month

A documented dispute is the step before a lawyer, and it is the step we built. CreditRefresh reads your credit reports, flags items that look inaccurate, incomplete, unverifiable or too old to be reported, and drafts a ready-to-send FCRA letter for each one, for all three bureaus. You review and sign every letter, then mail it yourself or have RushMail send it for a small per-letter fee.

CreditRefresh is included with Refresh Monitoring at $49.99 a month, with no setup fee, no per-dispute charge and no contract, and you can cancel anytime. Rory D. gave us five stars on Trustpilot on September 20, 2026: “Found errors that I was unaware of in a very short time”.

Members who work the full twelve-month program and never see a bureau score rise above where it started can claim back every payment, under conditions at creditrefresh.ai/guarantee. RushMail per-letter fees are billed separately and are not refunded. We are not a law firm, our letters are not legal advice, the bureaus decide outcomes, and results vary and are not guaranteed.

Frequently Asked Questions

How long do you have to sue under the FCRA?

An FCRA lawsuit must be filed by the earlier of 2 years after you discover the violation or 5 years after it happened (15 U.S.C. § 1681p, 1970). A violation you never discover still expires at the 5-year mark. State law, debt type and later actions can affect the deadline, so talk to an attorney well before the 2-year mark.

Can you sue over a credit report error that did not cost you money?

Yes, for a willful violation. The FCRA allows damages of $100 to $1,000 without proof of a dollar loss, and the Eleventh Circuit held in Santos v. Experian (2024) that consumers do not have to prove actual damages to recover statutory damages. Whether your facts qualify is a question for an attorney.

Can an FCRA attorney remove a negative item that is accurate?

No. The FCRA says a bureau is not required to remove accurate derogatory information unless it is outdated or cannot be verified (Federal Trade Commission, 2026). A lawyer enforces the rules on how the bureau and furnisher handle your dispute. That is different from making an accurate item disappear.

Is it legal for a credit repair company to charge you before it does any work?

No. The Credit Repair Organizations Act bars a credit repair organization from charging or receiving money for a service before it is fully performed (CROA, 1996). For services sold over the phone, the FTC’s Telemarketing Sales Rule says no fee may be taken until the time frame the company promised has passed and it has provided a consumer report, issued more than six months after the results were achieved, showing the promised results.

What should you check before you pay a credit repair company?

Ask for a written contract that states the total cost, a full description of the services, how long they will take, and the company’s name and address. You get a right to cancel without penalty until midnight of the third business day after signing (CROA, 1996). Ours has no contract and no cancellation fee, and you can cancel anytime.

Is CreditRefresh a credit repair company?

CreditRefresh is software the user controls, not a credit-repair agency, and every letter is reviewed and signed by you before anything is sent. If a bureau verifies an item you still disagree with, the next step is a Method of Verification request, which we can also draft. For litigation, garnishment or active identity theft, an attorney is a better fit.

CreditRefresh drafts a letter for each flagged item, and you choose what gets disputed, approve every letter and keep the record a lawyer would ask for if the first dispute fails. Backed by a 100% money-back guarantee.
