Bankruptcy usually hurts your credit more than foreclosure. It can reach every debt in the filing and stays on your report longer, up to 10 years for a Chapter 7 against about 7 years for a foreclosure.
The size of the drop still depends on your score before the event and on the rest of your file. If you are behind on the mortgage or already past it, the part you can still control is whether everything reported afterward is accurate.
Does bankruptcy or foreclosure hurt your credit score more?
Bankruptcy usually hurts your credit more than foreclosure, because it can cover every debt in the filing while a foreclosure centres on the mortgage account. myFICO puts the typical drop at 100 points or more for someone with a score in the mid 700s.
For a foreclosure, myFICO’s chart shows a 140 to 160 point drop from a starting score of 780 and an 85 to 105 point drop from 680 (myFICO, 2011). The two events do different kinds of damage. A foreclosure marks one mortgage. A bankruptcy marks the case and every account swept into it.
How long does bankruptcy stay on your credit report compared with foreclosure?
Chapter 7 bankruptcy can stay on your report up to 10 years, a completed Chapter 13 for 7 years, and a foreclosure for 7 years (myFICO). That puts a Chapter 7 on your file longest.
The Fair Credit Reporting Act (1970) sets the outer limit for a bankruptcy case at ten years from the date of the order for relief. A bankruptcy still showing past its window is disputable on age alone. The dates on your report matter for that reason.
How much do your starting score and other debts change the damage?
A higher starting score falls further. In Bills.com’s 2011 example, a 680 score drops 130 to 150 points after a bankruptcy and 85 to 105 after a foreclosure, while a 780 score drops 220 to 240 and 140 to 160 (Bills.com, 2011).
Your other debts change the picture. A foreclosure resolves exactly one debt, the mortgage on the property sold, and every other obligation stays enforceable (LegalClarity, 2026). A bankruptcy discharge can cover credit card balances, medical bills and personal loans in one proceeding (LegalClarity, 2026). If the mortgage is your only trouble and other accounts stay current, a foreclosure can do less damage. If cards and medical debt are piling up too, bankruptcy reaches more of your file.
How soon can you buy another home after bankruptcy or foreclosure?
After a Chapter 7 bankruptcy, Fannie Mae’s standard wait for a new mortgage is 4 years from discharge, or 2 years with documented extenuating circumstances. After a Chapter 13, the wait is 2 years from discharge or 4 years from dismissal (Fannie Mae, 2019).
After a foreclosure, the CFPB says it is possible to qualify for a mortgage, though a foreclosure will hurt your credit (CFPB, 2024). These clocks start from dates on your file. Check those dates against your court papers.
When is bankruptcy or foreclosure the wrong choice for you?
Bankruptcy is the wrong fit when the mortgage is your only problem and everything else is current. Foreclosure is the wrong fit when many other debts are overwhelming you.
A Chapter 13 filer can usually keep their property, but must have regular income and agree to a court-approved plan. In a Chapter 7, a trustee sells property of value, and you keep real estate only depending on state law (U.S. Trustee Program). Before either, the CFPB lists refinance, loan modification, repayment plan, forbearance, short sale and deed-in-lieu among the options a servicer can offer (CFPB, 2026). Get a complete application to your servicer more than 37 days before the sale, and you should hear back in writing within 30 days (CFPB, 2024). Whether to file belongs with a bankruptcy attorney.
How do you fix wrong items on your credit report after bankruptcy or foreclosure?
You can dispute anything inaccurate, incomplete or unverifiable, such as a balance on an account the bankruptcy discharged, a wrong date, or a mortgage reported as late after the event. Send a letter to each bureau. Under Section 611 of the Fair Credit Reporting Act (1970), the bureau must reinvestigate, in general within 30 days, and delete or correct what it cannot verify.
Accounts included in a bankruptcy should report as included, with a zero balance. Each wrong line is disputable on its own. Build each letter the way the CFPB publishes it:
- Give your complete name, address and telephone number.
- List each error, with the account number for any account you dispute.
- Explain clearly why you dispute it.
- Include a copy of the report page with the disputed items circled or highlighted.
- Attach copies, not originals, of supporting documents.
- Send it by certified mail with a return receipt if you choose.
- Submit it to Equifax, Experian or TransUnion online, by mail or by phone.
- Keep copies of everything you send.
- The bureau must investigate and pass your information to the company that reported the item.
- Then dispute in writing with that furnisher, by certified mail.
- The furnisher generally must respond within 30 days.
Bankruptcy hurts more, but you control what the report says afterward
Bankruptcy reaches more accounts and stays longer, so it hurts more. Neither event gets the last word on your file. Every balance, date and status reported afterward is yours to check, and the wrong ones are yours to dispute.

Frequently Asked Questions
Can you rebuild your credit after bankruptcy or foreclosure?
Yes. The CFPB lists 10 years on the report for a Chapter 7, 7 for a Chapter 13 and 7 for a foreclosure (CFPB, 2025). An entry being on your report is different from how much it weighs, so rebuilding starts well before it ages off. Make sure every new line reads accurately.
Can a bankruptcy or foreclosure come off your credit report early?
Only if the entry is wrong. No one can legally remove accurate negative information, but you can ask for an investigation, at no charge, of anything you dispute as inaccurate or incomplete (U.S. Courts, 2026). A bankruptcy still reported past its window is disputable on age alone.
Will a dispute tool remove an accurate bankruptcy or foreclosure?
No. Under the Fair Credit Reporting Act, you can dispute information that is inaccurate, incomplete or unverifiable. CreditRefresh drafts letters for items that look inaccurate, incomplete, unverifiable or too old to report. An accurate entry stays until its reporting period ends.
What should accounts show after a bankruptcy discharge?
Included accounts should report as included in bankruptcy, with a zero balance and no delinquencies after the filing date. A creditor may report later delinquencies on a discharged debt when you continue or resume payments, as long as what it reports is accurate, complete and updated (Federal Trade Commission, 2000). Each violation is disputable on its own.
Should you check all three credit reports before deciding between bankruptcy and foreclosure?
Yes, because each bureau holds its own file. The three nationwide bureaus let you get your report free online once a week at AnnualCreditReport.com (Federal Trade Commission, 2025). Read the balances, statuses and dates on all three.
CreditRefresh drafts a dispute letter for every item on your reports that looks inaccurate, incomplete, unverifiable or too old, so you can challenge what is wrong after a bankruptcy or foreclosure. The guarantee terms are at 100% money-back guarantee.
